Judicial Foreclosure In CaliforniaJuly 28th, 2008

To secure the loan, these financial lending institutions must be certain that they will get back their money back. Since a good paying job does not guarantee that a loan of this magnitude will be paid back, they require what is known as collateral, an asset they can seize in lieu of payments if the loan is in default (no longer being paid back).

Normally the home that is being purchased with the loan is put up as collateral and if the mortgagor (person seeking the loan) does not pay back the loan to the mortgagee (money lender, borrower), the house goes into foreclosure. The money lending institution may obtain a court order to proceed with the foreclosure and repossess or seize the house in lieu of repayment of the loan.

In some instances the financial lending institution may attempt foreclosure on a home or other property, but if the borrower repays the loan, a court of equity may rule in favor of the borrower who at that point will be able to keep the home or property in question.

The contract between the financial lending company and the borrower is called a mortgage or deed of trust. When a contract has been entered, effectively the lending company has agreed to give the borrower a certain sum of money in which to purchase the said property. The borrower agrees to pay this money back (signs a promissory note). The contract will also stipulate that a lien will be placed on the property meaning that the financial lending company has a right to seize the property (repossess it) if the loan is not repaid in the time frame that is stipulated and according to the conditions set out in the contract.

The process of foreclosure is used in any contract whereby real estate, homes, farms, land, and other immovable property has been obtained through a mortgage, and the mortgage holder has defaulted on the payments.

Judicial Foreclosure is available in all the American states. When the borrower defaults on the loan, the property is sold. The proceeds from the sale of the property first goes to repay the balance on the existing loan, then to any other lien holders, and finally to the borrower if any proceeds are left over. All transactions are done legally through the court system.

Foreclosure by power of sale is sometimes added as a clause in the mortgage contract that defines the foreclosure procedure without court intervention. This procedure follows the same order as the Judicial Foreclosure however faster since the courts are not involved.

Home foreclosure is one of the most common problems that people face today. More often than not it originates from one missed payment which spirals out of control. Before you know it you have missed three or four payments and the mortgage lender or bank wants you to pay everything you owe all at once. This sounds like a very difficult feat and many are lead to believe that they have no other choice. When the homeowners realize that they have made a grave mistake they resort to anything they can to get out of a tight situation.

This is when the swindlers find their way into your mailbox or give you a call. Foreclosure scams are very common as much as the problem itself. Since homeowners believe that they have no choice they fall for these traps and make their situation much worse than it was.

Scam operators also advertise online, publish advertisements in the local newspaper, distribute flyers, and call homes which are included on the foreclosure list. They call themselves mortgage consultants who offer foreclosure services or advertise with "We buy houses" slogans.

These are the most common foreclosure scams:

Bankruptcy Foreclosure Scam

They operate by promising the homeowner that their house will be saved. In return they will either ask for the homeowner to pay their mortgage directly to them, hand over their deed and pay rent, or obtain refinancing. But instead of fulfilling the other end of the bargain they don't contact your lender or obtain refinancing for you. They keep all the money and file bankruptcy without your knowledge.

Since the homeowner is not aware that bankruptcy has been filed, they fail to participate in the case. The case is dismissed and the house continues onto foreclosure. Apart from losing money and your home, you will also have a bankruptcy on your record.

Equity skimming

The operator poses as a buyer. The operator promises the homeowner to pay the mortgage or given them a sum of money once the property has been sold. The operator then convinces the homeowner to sign over the deed and move out. The homeowner can stay but they have to pay rent. If they opt to move out the operator lets a third party rent the property. The operator does not pay the mortgage and lets the mortgage lender foreclose.

If the house has equity, the operator sells the property and pays off the debt. Then the operator keeps the equity that the homeowner could have had if they sold it.

That route is known as the loss mitigation process. Here are some tips that explain, as to how the loss mitigation process can stop home foreclosure.

Find Out The Various Types Of Loss Mitigators: There are various loss mitigators that can help you to save your home. There are independent loss mitigators that can even be found over the Internet. These people act independently and will help you by explaining the various options that can be followed, in order to avoid your home from being foreclosed. There are also loss mitigators appointed by various banks and other lenders that do the same thing. The advantage to catch hold of a bank loss mitigator is that since they already know the key personnel in your bank or lender, the channel of communication can remain clear. This will make it easier for you to re-negotiate your terms with your bank or lender.
Find Out The Various Options That You Can Adopt: Your loss mitigation counselor can offer you various options to stop the foreclosure process. He/she can communicate with the bank regarding your delicate financial situation and re-negotiate your mortgage payments by reducing the size of the installments. This will help you to pay smaller loan installments, until your situation improves. The counselor can also request the bank to roll-over your installments for a particular period, for example for three to six months, to the end of the loan term. This will free you from paying any installments for a particular period and give you some time to get back on your feet. The loss mitigation counselor might also be able to convince the bank or lender to accept a short sale, i.e. convince the bank to accept a value less than the outstanding mortgage amount. The percentage of loss that the bank might absorb differs between various banks and it will be your counselor's skill that might enable you to get a good deal. Even if you follow any of the above paths, you will still have to prove to your bank or lender that you have the finances required to clear the mortgage payments. In case you are unable to do so, then the bank or lender will have no choice, but to put your home up for foreclosure.
Your Bank Or Lender Will Co-Operate: There are high chances of your bank or lender co-operating with you, since they would not want the home to enter into a foreclosure auction. This would turn their asset into a liability, as they would most certainly recover only a small portion of their outstanding dues in this method. The paperwork involved would also be quite high. Thus, if you manage to show them some money and if your loss mitigation counselor can convince them of your intent to pay, then you could save your home from foreclosure.

Your loss mitigation counselor can therefore act as a mediator between you and your lender or bank and try to ensure that you do not lose your home by convincing them to go easy on you, until you are financially sound again. Even if your bank or lender has put the foreclosure process in motion, the loss mitigation process can ensure that you get one final shot at saving your home.

What is Mortgage Reinstatement?

By definition, a mortgage reinstatement is restoring a loan after the lender files foreclosure against the borrower who never made payments, even after the given grace period. During the process of foreclosure, the lender will deactivate the non-paid loan until a trustee sale. Prior to a trustee sale, the borrower can still reinstate the mortgage loan up to five days before the foreclosure auction.

In order to achieve a mortgage reinstatement, the borrower must bring their mortgage note current and pay only with "good funds" the delinquencies including other fees and charges. Once received, the lender will return the loan back into active status.

However, this happens under statutory regulation. In most states, borrowers have the right to reinstate their mortgage before the trustee sale, like for example in California and Oregon. Unfortunately borrowers living in Georgia cannot reinstate their mortgage before the trustee sale.

Foreclosure and the right of reinstatement

On mortgage defaults under a promissory note and deed of trust, the lender has the option to:

Exercise the power of sale clause in the deed of trust and file a notice of foreclosure against the borrower to the trustee.
Collect the note due, accelerate payment of the entire mortgage amount and initiate judicial foreclosure.

Typically, lenders prefer foreclosure by a trustee sale because it is hassle-free and less expensive. As a borrower you must know your statutory rights when this happens. There is actually a reinstatement law that applies to both options such that:

Under Arizona Revised Statute Section 33-813(A), the borrower is obligated to pay only "the entire amount then due..., other than the portion of the principal as would not then be due had no default occurred..." Meaning, the borrower (trustor) may reinstate their mortgage (or fix the default under the promissory note) by paying the lender the delinquent dues only, contrary to the belief that the borrower must pay the entire loan amount in order to fix the default and reinstate their mortgage.

In addition, Chapparral Development v. RMED Intern, 170 Ariz. 309, 823 P.2d 1317 (App. 1991), the Arizona Court of Appeals ruled that under A.R.S. Section 33-813(A), a borrower (trustor) has an absolute right to a mortgage reinstatement regardless if a lender forecloses by trustee's sale or judicially. The difference is:

In judicial foreclosure, a borrower's right of reinstatement is cut off once a foreclosure action is files and the borrower must pay the entire amount owed on the promissory note.
In the context of a trustee's sale, the borrower can reinstate up until 5:00pm on the day prior the date of the auction. However, their mortgage reinstatement rights will be extinguished once the sale is held.
