Every bailout the government has given to the banking system has been designed to stabilize the housing and stock markets, keep access to credit open, and keep people in their homes. But despite these stated goals, all that has happened is the banks are hoarding the free money, jobs are still being lost, and homeowners are going into foreclosure in record numbers.

Banks and the government worked together to enrich themselves through the real estate boom and turn communities into dumping grounds for easy loans. Now that the bubble has burst, banks and the government have been working together to ensure that only the people in those pump-and-dump communities feel the effects of the meltdown.

But it is not just that nothing is being done to help people stay in their homes. The government has come up with numerous programs ostensibly designed to help people stop foreclosure in certain instances and help borrowers work with lenders to modify mortgages.

An even worse problem, though, is that these programs take money from everyone else through inflation to help a very, very small number of homeowners. And if the programs are ineffective (which they have been so far), they may actually cause more people to face foreclosure.

All of this inflation where the government prints money and throws it at banks will also result in higher prices down the road. The banks are hoarding the money now in order to cover future losses they know are coming from other bad investments, but eventually they will begin making poor loans again, inflating another bubble before another collapse.

One argument that has been made is that it is far too difficult to throw small amounts of money at hundreds of thousands of homeowners to stabilize the system. So the government throws large amounts of money at a few small institutions, which is supposed to help everyone by maintaining faith and support of the financial system.

The problem is, these banks, once the government bails them out, have absolutely no incentive to work very hard with homeowners to save homes from foreclosure. With essentially free money, banks can sit back and do nothing, crying for more money when more people face foreclosure.

And this is exactly what it seems the banks are doing. Create a crisis, deliberately fail to respond to the fallout, cry for a government handout, use the bailout to act even lazier, not respond to further fallout, cry for more handouts, and so on.

Also, the few government programs designed to help homeowners work with their banks put restrictions on the lenders and require them to recognize losses on delinquent loans. So obviously, the banks are very concerned about having to admit to even more losses caused by bad mortgage loans, which might drive their stock prices down.

There is no real incentive for the lenders to take losses on loans and work with borrowers to restructure defaulted mortgages. In fact, there is a much larger payoff if the banks keep the foreclosures, do nothing to respond to them, and go to the government claiming a crisis that requires enormous amounts of taxpayer money to solve.

The bailout plans (especially the most recent $700 billion one) have required nothing from the banks other than that they be in serious trouble and need money. There are no restrictions and the banks can dump these bad loans directly onto the government, instead of having to work with homeowners.

The government has given the banks an incentive to keep making bad loans and then never address the problems caused by shoddy lending guidelines. The more people they foreclose on, the more free money they can cash in on from the bailout plans. So nothing will continue to be done to help homeowners stay in their homes.

What this means to the investor is that you will probably get the property back a number of times and be able to lease option it again.

Each time you enter into a lease option agreement you get a non-refundable option consideration from your tenant buyer.

Many investors are getting anywhere from 10 to 30 percent for an option consideration. Just be sure to have your attorney look over all of your contracts to make sure you comply with state laws.

For an example: Texas is one state that doesn't allow lease options. In Texas you must use an all inclusive deed of trust. Just make sure you comply with all of you state and local laws in each and every transaction you do.

A lease option is actually a acombination real estate rental, sales and finance technique. It is a property lease for a fixed time period, such as 12 or 24 months, with an option for the tenant to buy the property at an agreed option price during the lease term.

Buyers like lease-options because little up-front cash is required. Sellers also like lease-options because they provide necessary cash flow to pay the mortgage and property taxes from a tenant who has a vested interest in treating the property well and who is likely to buy it.

Now lets discuss the advantages to both the buyers and the sellers in a lease option transaction as there definitely namy benefits for both.

Unless your property is located where there is very strong demand from buyers, lease-options can be especially advantageous for home sellers.

The lease option solves this problem by giving the tenant-buyer a rent credit toward the down payment. It's like a forced savings account. In addition, the tenant-buyer usually pays up-front nonrefundable consideration for the option, typically several thousand dollars.

Because of strong buyer demand for lease-options, when done correctly, home sellers can demand and get top dollar for their properties.

Usually, the option price is set at the market value when signing the lease-option. If the home's market value goes up during the lease-option term, the buyer benefits. Should the property drop in value, then the tenant usually doesn't complete the purchase.

During the lease-option, the tenant-buyer usually take good care of the property as if they own it. Another seller advantage is earning above-market rent. Landlords can charge tenants 10 to 20 percent above market rent.

During the lease-option period, the seller retains all the property income tax deductions. If a tenant complains about not receiving any tax benefits, a reminder about the rent credit toward the down payment usually ends the discussion.

Lease-option benefits are not one-sided. Advantages for buyers include: The amount of up-front cash required to acquire a home or other property on a lease-option is usually small, often just a few thousand dollars for the first month's rent plus non-refundable option consideration. This option money is in lieu of a security deposit.

The unique characteristic of a lease- on option is the rent credit toward the buyer's down payment. Typically, the rent credit is 10 to 100 percent of the monthly rent, depending how motivated the seller is to sell. The higher the rent credit percentage, the greater the probability the tenant will buy.

Another special lease-option benefit for the tenant is the ability to try out the property before buying. If it is undesirable, the tenant hasn't tied up a large amount of cash in a home that might be difficult to resell.

The ability to control a property and profit from its market value appreciation with very little cash is called leverage. Lease-option buyers have this unique advantage.

Although most residence lease-options are for short terms, such as one or two years, smart investors seek lease-options with the longest possible term. They reason the property is likely to appreciate in market value over the long term so everyone wins, and that's the way all transactions should end.

Power of Sale Foreclosure vs. Judicial Foreclosure, how fast can the bank foreclose?

First of all, most lenders will not begin foreclosure proceedings until a borrower is 3-6 months behind on their payments. Although missing a single payment is a default under the terms of most loan documents, lenders have neither the time nor the desire to foreclose on borrowers who have missed one payment. The process will be initiated when it becomes clear that the debt can no longer be serviced. This post deals with the timing of a foreclosure once your lender has started the process and has instituted a foreclosure action against your property.

The speed with which a bank can foreclose on a borrower varies based on state law. There are basically two different types of jurisdictions for foreclosure purposes: power of sale jurisdictions and judicial foreclosure jurisdictions. In over half the states, the prevailing method of foreclosure is non-judicial power of sale foreclosure. What does this mean? If you have entered into a deed of trust with your mortgage lender, your deed is held by a Trustee pending full payment of your note. In the event you fail to make your mortgage payments the trustee has authority to sell your home at auction. Power of sale foreclosure can occur much more quickly than judicial foreclosure because the trustee vested with the power of sale does not need court oversight to sell the property. The trustee will give Notice of a public foreclosure sale and then sell the distressed property to the highest bidder. A court will usually not oversee the process. If a default has occurred the trustee is permitted to go through with the

foreclosure sale after a relatively short notice period (usually two to three months from the date foreclosure proceedings are instituted). If you live in a power of sale Jurisdiction, your mortgage lender can complete the foreclosure process in two to three months. Today, 29 states (Alabama, Alaska, Arizona, California, Colorado, the District of Columbia, Georgia, Hawaii, Idaho, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nevada, New Hampshire, North Carolina, Oregon, Rhode Island, South Dakota, Tennessee, Texas, Utah, Washington, West Virginia and Wyoming) allow foreclosure by the power of sale

Judicial foreclosure is available in every state and is the required method of foreclosure in many states. Judicial foreclosure jurisdictions require a court to oversee the foreclosure process. Like power of sale jurisdictions, all interested parties must receive notice of the foreclosure sale. Judicial foreclosure proceedings can take a year or more to be completed . The requirement that the lender foreclose through the court system slows down the process considerably. While either method of foreclosure can be successfully challenged by an attorney, the court oversight of judicial foreclosure allows more procedural leverage to slow down aggressive lenders.

It is important for consumers to understand that they have rights in the fight against foreclosure. Power of sale jurisdictions allow for your property to be sold outside of court supervision but they still require you receive adequate notice of the sale and that your property be sold for a reasonable price. Hiring an experienced foreclosure defense attorney in a judicial foreclosure jurisdiction could buy you months while you fight back against the bank. Bankruptcy, although a last resort, will stop a foreclosure dead in its tracks due the Automatic Stay that freezes all creditor collection actions the minute a case is filed. I have filed many bankruptcy cases for clients the night before their home was scheduled to be sold at auction and had the process stopped. Chapter 13 bankruptcy may allow you to stay in your home while getting caught up on mortgage arrearages that have spiraled out of control. You have options and there is help available, but remember if you are in a power of sale jurisdiction and have

executed a deed of trust with your lender, the foreclosure process can be completed in a matter of months.
