In the state of Hawaii, both judicial and non-judicial foreclosure proceedings are recognized. Non-judicial foreclosure proceedings must be in agreement with a clause found in the mortgage. It may also require the lender, before starting the foreclosure process, to notify the borrower of the default.
Judicial foreclosure proceedings begin when appropriate documents by the lender have been filed. The lender asks that the court rule that the borrower is in default.
The borrower will be found in default if they do not respond to the court within 20 days. The lender can then proceed with scheduling the foreclosure sale. Within 30 days of the filing, the borrower may file a notice of appeal.
The borrower has up until 3 days before the sale, to pay the debt and costs associated with the default.

Anyone can bid as long as they have 10% of the bid in cash or cashiers check. In this case, the highest bidder might not get the bid, more bidding may happen. At the confirmation hearing, the court determines whether the price is fair.
There are no redemption rights for the borrower in the state of Hawaii, once the sale is confirmed.

There are two popular notions about foreclosed homes: they are being sold at bargain prices and that they are only located in crime-ridden areas. The former is not entirely true while the latter is definitely inaccurate.
The price of foreclosed properties can be 30% to 40% cheaper than their current market values but that doesn't necessarily apply to all. Most houses will likely be sold at 5% less than their current value. This is because banks decide the listing price with respect to the condition of the property. Factors including the location and the type of neighborhood where the property is will also affect the listing price of the property. A common notion that a foreclosed home can be bought cheap, only requires a little fixing up, and can be sold at a hefty price is a big misinterpretation. Well, some properties may fit this idea, but it really doesn't work that way all the time.
For foreclosed property buyers, this means one thing: in order to get the best deal, you really have to put time and effort in finding the best property on sale. One thing you have to remember if you are considering this kind of investment is that banks will definitely not sell off the properties at cheap prices as they are being appraised first before they go into listings. They know the value of homes that they have foreclosed and they don't treat them as liabilities, but as assets.
What about those properties that sell at bargain prices? Most, if not all, require major repairs or have eviction issues, or both.
Foreclosed properties can be found everywhere and can come in any form, shape, size, and price. This is contrary to the popular belief that foreclosed homes can only be found in crime-ridden areas. Meaning, finding a country villa, log cabin, beach front home, and prime property among many others are within your viable options. But you should never, ever expect that these properties are sold dirt cheap. As the old saying goes, "you get what you pay for." So, if you are eying a premier foreclosed property, just expect to pay the real cost or slightly lower than its current value because in the end, saving you from the trouble of repairs and dealing with the bad neighborhoods are really worth the extra bucks.

However, for most people, the urgency to make a move and solve the problem is not so urgent that when they do something, they act out of desperation. As a result, they seek help from "companies" that promise to save their home but are actually scams. So, to avoid becoming one of the victims, here are some red flags you should be aware of:
Equity Skimming - An offer of "temporary" transfer of ownership
In this scan, the person (third-party) will act as a buyer of the house and will promise to fix any financial problems with your lender in exchange of signing a "temporary" transfer of ownership. You will be asked to pay your rent while they take care of your mortgage.
In reality, the third-party doesn't negotiate with your lender and will even use the equity you have built up in your home as a lien for new loans pushing your much closer to foreclosure. Your equity is lost, your mortgage is unpaid, and your rent is gone.
Overnight Foreclosure Rescue
If the offer sounds too good to be too, it usually is. Do not sign papers saying that you allow the company to represent you on your behalf.
Up-front Service Fees
Since most homeowners are embarrassed to discuss financial problems with their lenders, some take the services of home counseling agencies to represent them to their lender. While there are legitimate businesses that can help you with your problem, others are there to rip you off. An agency that charges with a certain fee especially up front is a red flag. To be sure, contact HUD-approved counseling services.
A foreclosure help in exchange of signing tons of papers you can't understand
Don't give in if someone approaches and asks you to sign papers with a promise to save you from mortgage problems. Consult your attorney. Do not sign papers with blanks and spaces. Review the paperwork. Do not sign anything you do not fully understand. Beware: you might be signing over the deed of your home.
Unsolicited Mail
Since mortgage records are public documents, don't be surprised if you receive mail about the standing of your mortgage from different companies. Some of them are legit. But don't be fooled by professional looking letters. Unsolicited mail is usually a red flag.
