The media, politicians, and armchair real estate professionals seem to have begun making a part time job of analyzing what should be done to solve the foreclosure crisis. The debates so far, however, have been somewhat limited to the possibility of the government stepping in and providing relief to homeowners, or doing nothing and allowing home prices to crash. Instead of expecting more from the government, it would make far more sense for the bureaucrats to scale back many of their activities in all aspects of the average person's life.

One simple proposal may just be getting rid of the personal income tax altogether. While no one would mourn the loss of the IRS, those who fear that all federal government services would dry up should realize that the government could be the size it was in 1997 if the income tax were eliminated. Also, even though many people never pay anything to the IRS and simply receive a refund every year, it would be much better for those people to have that money in their pockets all year to help pay for mortgages, transportation, or food. Giving an interest-free loan to the government all year when one is unable to pay back their own loans makes little sound financial sense.

Politicians should also stay out of the housing crisis altogether, as this is not a problem that we can legislate our way out of. The Orwellian named Foreclosure Prevention Act was a complete joke and illustrative of the impossibility of just creating more laws and acts to solve market problems, designed to take more tax money from homeowners in order to hand out tax breaks to home builders, banks, automobile companies, and the airline industry. Leave it up to the elected lawyers to redefine the phrase "foreclosure relief" to mean "foreclosure victims relieving corporations of their tax burdens."

As well, unless the Iraq War and our other overseas commitments are scaled back enormously, the perpetual borrowing and inflating needed to sustain the perpetual war industry will bankrupt the country. Spending over a trillion dollars every year on military bases, covert operations, no-bid weapons contracts for projects that are never completed, and subsidies for defense contractors creates an unsustainable drain on the productive capacity of society. There are many more goods and services that people want when they are at peace than when their efforts must be spent on repairing destruction.

A final idea would be for the federal government to begin to transition towards real, sound money, based on gold or silver or some basket of commodities. While it is unlikely that this will happen without a large-scale economic meltdown and reorganization, private citizens can invest in gold and silver coins on their own. Local governments, too, may wish to look into instituting their own local currencies, to put more direct control of the money supply back into the hands of people and communities. This would also strengthen towns and counties that have been hit hardest by lack of money or disappearing production and jobs.

Simply handing over one's tax dollars and then demanding a "solution" to the housing crisis from Congress is a sure way to an even deeper economic recession. As evidenced by the "Foreclosure Relief Act," it is clear that politicians spend more time thinking of how to trick the people into supporting more corporate welfare than actually addressing how to help homeowners stop foreclosure. Unfortunately, it may be that the country itself will face bankruptcy very shortly and the dollar will face a total collapse; therefore, the most effective solutions will be found with private citizens and in local communities, rather than the bureaucrats in Washington.

Many states are experiencing an extremely high rate of homes in foreclosure. This is due to the influx of past years risky lending methods now catching up with the homeowners that took chances and are now paying the price. In recent years lenders and buyers alike have been desperate to get into the housing market. Many buyers were willing to do anything to get the home of their dreams and many lenders were more than willing to do whatever it takes to get the mortgage papers signed.

Many predatory lenders have allowed consumers who were previously unable to obtain a mortgage, the opportunity to get one with little or no money down. Some of these products allowed the home buyers to purchase and pay only the interest for the first several years and then begin balloon payments at the stated time in the contract. In retrospect, if they were able to refinance before the balloon payments kicked in, they would have had an excellent strategy for getting into their home. The problem is that too many of these buyers were not, and still is not, in any position to refinance or change their financial situation in any way. They are either worse off than they were when they signed the mortgage, or have been put, or put themselves in, a situation where they are stuck.

Real estate businesses know that these types of mortgages are risky for the buyer and the bank as well. Let's face it; they are in the business to make money. Their bottom line is their bottom line. Therefore, if they make the sale and get the contract signed, they have done their job and been compensated for it. Their responsibility is over. Too many people are misinformed or just plain uninformed by their realtors what they are getting themselves into.

Michigan is a state that is not alone in this current crisis in mortgage foreclosures. In a report from the Office of the Attorney General, Michigan continues to have one of the highest rates of foreclosures in the country. They further state, as anyone can guess, that foreclosure is the nightmare no homeowner wants to face. This seems like simple logic and common sense, but if that is the case, why the continuing increase of loan defaults and foreclosures? Real estate agencies, realtors themselves, and the risky lending practices all have a hand in what we see in the market and in the financial world today.

Some states are helping the consumer with this overwhelming problem. They are holding "Avoid Foreclosure: Tools to Help Save Your Home" forums for homeowners to attend to get advice. The forum allows consumers to work with some of the largest loan and service providers not only for advice and guidance, but also make those providers, and independent loan counselors available to those who attend. Avoiding foreclosure is something that many in today's home market can relate to and most people are willing to listen and ask for the help they need, especially when they are in default on their mortgage.

Although in appearance, this makes it look like Michigan is taking a stand to stop foreclosures from happening, but that is not the case. The guidelines for homeowners in default or foreclosure to qualify for the program are such that many people will be unable to take advantage of this opportunity. Some of these restrictions are anyone that is more than thirty days late when they inquire would be modified. This includes those who have been more than sixty days late within the last twelve months. This plan, which calls to freeze rates for the homeowner, only covers those mortgages that are set up as an adjustable rate mortgage.

Ultimately, there is no real cure or solution for the growing problem with increasing numbers of foreclosures in Michigan and many other states. What we can do however is look at the past and current market and financial outlook and do our best to learn from it. We would all love to own our dream home, but in reality, that may not, and likely will not, happen for everyone. It is time to take a long look at appreciating what we can afford to have and do and be truly grateful for it. Although there are many mortgage companies and real estate companies out there that would work out a deal for anyone that was willing and able, sometimes we just have to ask ourselves, just because we can, does that mean that we should?

Seniors can stall foreclosure by asking the bank to show proof they hold the original note. Yes, seniors can say produce the note and the banks must back off while they attempt to locate the original paperwork. It isn't fair that our government is bailing out banks, and then those same banks are foreclosing on our homes - evicting suffering home owners who are the real victims of this economy.

A by product of all the fancy wheeling and dealing with mortgages being traded from bank to banks during the previous financial hey-days is that original paperwork seems to be lost in many cases, or at the very least, difficult to find. One lady filed her produce-the-note demand last fall and was notified by the bank that her note was lost or destroyed - since then there has been no activity on the foreclosure, no letter from the lender, no court filings.

A University or Iowa study last year found more than 40 percent of the 1700 bankruptcy cases studied, banks could not find the necessary paperwork. Oregon is a "judicial foreclosure" state, meaning the courts are involved in foreclosure proceedings. I have the forms, free, to use in filing you're "produce the note" strategy.

In "non-judicial foreclosure" states, such as California and Texas, the homeowner must file a lawsuit against the party trying to foreclose in order to get the courts involved. Laws differ among states, but all states require the other side to produce relevant documents; and then the "produce the note" method can be used. Most of the above was taken from news sources and the consumer warning network. I am not an attorney. I have worked many years as a real estate broker and private investor.

The one thing I do want to leave you is this: DON'T GIVE UP! Hang in there long enough to make them re-negotiate your loan to terms you are able to live with!

California Judicial Foreclosure TimelineMay 27th, 2009

By definition, a Notice of Default is the letter that is filed by the lender against the borrower when they fail to pay their monthly mortgage obligations, even after being given a grace period to repay delinquencies. It is filed in the public records department where the property is located. This will jumpstart the foreclosure procedures, where lenders seize the property held in the mortgage.

In some states, for example in California, the Notice of Default is usually issued when the borrower is over 60 days late. When this happens, a 90-day period shall be given to the borrower to catch up with their delinquencies and file for reinstatement. A Borrower's failure to do so will prompt the lender to initiate the notice of default by filing and publishing it in the local newspaper for 20 days. After which, the property will be put up for sale on its fair market value, either by judicial foreclosure or by power of sale to a trustee. The money raised will be used to pay the lender the outstanding principal balance of the loan. If there is still enough to pay the liens and other debts, they too will have their fair share. However, if nobody buys the property, the trustee will transfer it to the lender.

A notice of default officially starts the foreclosure process. At this time it is important to really be proactive in your efforts to save your home. The clock is ticking so to speak, and its very important that you contact your lender as soon as possible to try and work something out. Even if you cannot afford to repay the amount you are delinquent, most banks will have additional options available to you. The bank doesn't want to sell your home, but you need to speak to them as soon as possible to devise a plan to get you back on track.

Please keep in mind that during this time you may be contacted by numerous companies offering you their "help". It's important to be aware of loan modification scams and fraudulent companies. They know that a homeowner who has just been served with a notice of default may be more vulnerable to their tactics. A common foreclosure scam these companies use is when they ask you to transfer your property over to them and they will allow you to rent it from them until you can repay the debt owed. Do not fall for this! More often than not they will strip all the equity left in your home, and you will be left with nothing.

Judicial Foreclosure and Non-Judicial Foreclosure are both methods comprising Arizona Foreclosure laws. Under this legislation, a Judicial Foreclosure simply requires a lawsuit in order to obtain a court order to foreclose. This becomes necessary when there is not a power of sale written into the mortgage or the deed of trust.

A power of sale is a clause in the mortgage or deed of trust giving the lender permission to sell when a default occurs. When the power of sale is present, the courts are not part of the foreclosure process, permitting a Non-Judicial Foreclosure to go forward; this is the most common method of Arizona foreclosures.

A notice of Trustee Sale is filed in the county recorder's office, and allows a 90 day period from the date of that notice, giving the property owner a chance to pay off the lien. All parties affected by the sale are notified by the Trustee, but during this time and the 90 day waiting period following the Notice of Trustee Sale being filed, the homeowner is still responsible for the property and all incurred debts.

It is only after all late payments have been made, including late fees, lender fees, and attorney fees, is the Notice of Trustee Sale voided and the property returns to the owner.

Should that not happen, the property is sold at auction and the owner loses all rights to the property. The proceeds from the highest auction bidder will pay off the primary lien. Any remaining balance goes to junior lien holders in a determined priority.

There are certain regulations governing how much the successful bidder at auction must put down at time of sale (usually $1,000), and a deadline set for payment in full. If this is not completed on time, the $1,000 is retained, and notice and deadline is given to the second highest bidder.
